The Battle Born Trail System (BBTS) is a curated network of Offroad routes developed, compiled, documented, and published by Nevada Offroad Association (NVORA).

The system includes the Battle Born Trail (BBT), the 1861 Trail, and other routes and informational resources developed or published through the BBTS project.

NVORA's work includes route research, field observations, route selection, original cartography, written descriptions, photographs, graphics, GPS navigation resources, and other materials intended to help the public explore Nevada responsibly.

NVORA makes these resources available to encourage responsible recreation, public awareness, and lawful access to Nevada's roads and trails.

Public availability does not mean that NVORA relinquishes its intellectual property rights in original materials it owns.

This policy establishes the terms under which NVORA authorizes the use and republication of its protected materials.

BATTLE BORN TRAIL® is a federally registered service mark owned by Nevada Offroad Association.

NVORA reserves its rights in the BATTLE BORN TRAIL® mark under applicable trademark law.

The registration protects the mark in connection with its registered services. It does not, by itself, confer exclusive ownership of individual route names, geographic locations, public roads, or trails.

Unauthorized uses that create confusion regarding the source, sponsorship, affiliation, or endorsement of goods or services may infringe NVORA's trademark rights.

The BATTLE BORN TRAIL® name may be used truthfully to identify or discuss the project, subject to applicable law. Such references must not falsely suggest official NVORA sponsorship or endorsement.

NVORA asserts copyright protection over qualifying original works it owns and publishes through the Battle Born Trail System.

These may include:

• Original maps and creative cartographic presentations.
• Written route descriptions, histories, narratives, and educational materials.
• Original photographs, illustrations, logos, and graphic designs.
• Original website text, publications, and downloadable documents.
• Copyrightable selection, coordination, and arrangement of route information.
• Original expressive elements incorporated into GPS navigation resources and other digital publications.

This protection applies to qualifying original materials associated with the Battle Born Trail, 1861 Trail, and other BBTS routes, regardless of whether those individual route names carry a copyright notice.

Copyright does not extend to the underlying geographic facts, public roads, trail locations, raw coordinates, or other material excluded from copyright protection.

Third-party materials remain subject to their respective owners' rights and licenses.

NVORA encourages non-commercial sharing and republication of its original informational materials.

Subject to the restrictions below, NVORA grants permission to reproduce and redistribute NVORA-owned BBTS informational materials for non-commercial purposes, provided that clear attribution accompanies the reproduced materials.

Attribution must be reasonably prominent and placed where readers or users can readily identify the source.

Examples include publication credits, map legends, website source references, presentation credits, and accompanying documentation for downloadable files.

Users must not remove existing copyright notices, falsely claim authorship of NVORA's protected works, or imply endorsement or sponsorship by NVORA.

This permission applies only to materials NVORA owns and has authority to license. It does not override separate restrictions accompanying specific materials.

Uses independently authorized by law or an existing license do not require permission under this policy.

NVORA welcomes the use of BBTS resources by federal, state, county, municipal, and other public agencies.

When an agency reproduces or incorporates NVORA-owned protected materials under the non-commercial permission granted by this policy, the agency must provide the required attribution.

This includes authorized republication of NVORA-produced maps, original route narratives, original cartographic presentations, and other protected content in government publications, websites, reports, visitor information, and recreational resources.

Public funding, public availability, or governmental status does not automatically place privately authored works in the public domain.

This policy does not restrict an agency's lawful ability to independently identify, survey, map, or describe public roads and trails, or to use materials under applicable statutory exceptions or other valid permissions.

For commercial uses, uses outside the scope of this policy, or uses requiring additional permissions, agencies should contact NVORA.

NVORA reserves its applicable intellectual property rights regarding commercial exploitation of BATTLE BORN TRAIL® branding and NVORA-owned original content.

Prior written authorization is required where applicable law gives NVORA the right to control the proposed use, including:

• Commercial reproduction or sale of NVORA-owned maps, publications, graphics, or other protected works.
• Use of BATTLE BORN TRAIL® branding on hats, shirts, patches, decals, souvenirs, and similar merchandise in a manner that infringes NVORA's trademark rights.
• Commercial products or services falsely presented as officially affiliated with, sponsored by, or endorsed by NVORA.
• Commercial licensing or redistribution of NVORA-owned protected content outside this policy's non-commercial permission.

Attribution alone does not constitute commercial-use authorization.

A factual reference to the Battle Born Trail, including in commercial communications, is not automatically prohibited. The legality of a particular use depends on the applicable trademark, copyright, and other laws.

BBTS provides digital route information intended to assist recreational navigation.

NVORA asserts applicable rights in its original cartographic works, written navigation instructions, creative presentations, and copyrightable compilations.

The availability of GPS files or digital route information does not automatically authorize reproduction of NVORA-owned protected content for commercial redistribution.

However, this policy does not claim exclusive ownership of geographic coordinates, route locations, public roads, or other uncopyrightable factual information.

Non-commercial users may share NVORA-owned protected route materials under the attribution permission stated in Section 4, subject to any additional restrictions expressly identified with the materials.

The Battle Born Trail System is a curated informational route network, not an officially designated trail system.

NVORA does not claim ownership of public lands, public roads, trails, or public rights of access through its trademark or copyright notices.

Route availability, legal access, and physical conditions may change.

Users are responsible for verifying current restrictions, closures, land-management requirements, and conditions before traveling.

Nothing in this policy authorizes travel on closed or restricted routes.

BBTS information is provided for general informational and recreational planning purposes.

Although NVORA endeavors to provide useful route information, it makes no guarantee that published information is accurate, complete, current, or suitable for a particular vehicle or activity.

Road and trail conditions may change without notice because of weather, erosion, flooding, maintenance, administrative decisions, private-property restrictions, or other circumstances.

Travel and reliance on BBTS information are undertaken at the user's own risk, to the extent permitted by applicable law.

Users should consult current official land-management information and exercise independent judgment regarding safety and lawful access.

NVORA also welcomes reports of suspected unauthorized reproduction, missing or misleading attribution, or misuse of its registered trademark.

Requests should identify the materials involved, their intended use, and where they will be published or distributed.

NVORA retains all applicable trademark, copyright, and other intellectual property rights in its protected marks and original works.

Nothing in this policy transfers ownership of any NVORA intellectual property.

Permission granted by this policy is limited to the uses expressly described and does not extend to third-party materials, unlawful activity, or uses that infringe NVORA's rights.

Nothing in this policy limits lawful fair use, independent creation, factual reporting, or other rights established by applicable law.
